Intellectual Property

Unless otherwise stated, all content published and made available on our Platforms is the property of Friendship Tree and/or the original content creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, and any other materials contributing to the composition of our Platforms. Where content is provided by third parties (such as charities), ownership remains with the original creators unless explicitly transferred. Your use of our Platforms and access to any content does not grant or transfer to you any rights, title, or interest in relation to our Platforms or the content.

Age Restrictions

The minimum age to use our Platforms is 16 years old. By using these Platforms, users agree that they are over 16 years old. We do not assume any legal responsibility for false statements about age.

Platform Use and Behavioural Standards

When you create an account on our Platforms, you agree to the following:

1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
2. All personal information you provide to us through your account is up to date, accurate, and truthful and you will update your personal information if it changes.
3. To uphold a respectful and responsible standard of behaviour. You must not do, or attempt to do, anything that is unlawful, prohibited by applicable laws, or that we consider inappropriate or potentially damaging to Friendship Tree or its Platforms. This includes, but is not limited to:
4. 1. 1. Breaching another person’s privacy (including uploading personal information about an individual without their consent) or infringing on any legal rights;
      2. Using our Platforms to defame, harass, threaten, menace, or offend any person;
      3. Interfering with another user’s experience or access to our Platforms;
      4. Tampering with or modifying our Platforms, knowingly transmitting viruses or other harmful code, or using any technology (e.g. trojan horses, malware, or piracy tools) that may damage or interfere with our Platforms;
      5. Using our Platforms to send unsolicited communications (e.g. spam); or
      6. Facilitating or assisting a third party to engage in any of the above behaviours.

We reserve the right to suspend or terminate your account if you are using our Platforms illegally or if you violate these Terms of Service.

Third Party Websites

Our Platforms may contain links to websites operated by third parties. We do not make any representations or warranties regarding the privacy practices of these third-party websites. It is the responsibility of third-party websites to inform users about their own privacy practices, including how the operators of those third-party websites collect, hold, use or disclose any personal information or other information that you provide them or which they collect. 

Warranties and Disclaimers

To the maximum extent permitted by law, Friendship Tree makes no representations or warranties about our Platforms or the content available on them, including but not limited to:

1. the completeness, accuracy, reliability, currency, or suitability of the content for any particular purpose;
2. uninterrupted, error-free, or virus-free access to our Platforms; or
3. the security of our Platforms.

You access and use our Platforms and any content at your own risk. We encourage you to exercise discretion and judgment when relying on any information or materials made available through our Platforms.

Limitation of Liability

To the maximum extent permitted by law, Friendship Tree will not be liable for any actions, claims, losses, damages, liabilities, or expenses (including legal fees) arising from your use of our Platforms, whether arising in contract, tort (including negligence), equity, statute or otherwise.

We are not responsible for any loss, damage, or expense whether direct, indirect, present, future, contingent, or unascertained suffered by you or any third party in connection with:

1. 1. 1. your use of or access to our Platforms or content;
      2. any inaccessibility, interruption, or outage of our Platforms;
      3. any loss or corruption of data; or
      4. any content that is incorrect, incomplete, or out-of-date.

Indemnity

Except where prohibited by law, by using our Platforms, you agree to indemnify and hold harmless Friendship Tree from any actions, claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of our Platforms or your violation of these Terms of Service.

To the maximum extent permitted by law, you must indemnify us and hold us harmless against any Liability suffered or incurred by us arising from or in connection with:

• your use of our Platforms; or
• any breach of these Terms or applicable laws by you.

This indemnity is a continuing obligation, independent of the other obligations under these Terms, and remains in effect even after these Terms end. It is not necessary for us to suffer or incur any Liability before enforcing our right to indemnity under these Terms.

Applicable Law

These Terms of Service are governed by the laws of the State of Queensland, Australia. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in Queensland and any courts entitled to hear appeals from those courts and waive any right to object to proceedings being brought in those courts.

If you access our Platforms from outside Australia, you are solely responsible for ensuring your use complies with the laws of your jurisdiction. We do not represent that our Platforms comply with the laws (including intellectual property laws) of the country in which you reside.

Severability

If at any time any of the provisions set forth in these Terms of Service are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms of Service. All other provisions will not be affected by the removal and the rest of these Terms of Service will still be considered valid.

Changes

These Terms of Service may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Platforms and the way we expect users to behave on our Platforms. We may, at any time and at our discretion, vary these Terms and Conditions by publishing the varied terms on our Platforms. We recommend you check our Platforms regularly to ensure you are aware of our current terms. Content is subject to change without notice. Continued use of our Platforms after changes are published will constitute your acceptance of the updated Terms.
